Terms of use

Velvet Hanger is an iPhone app operated by Bora Technologies (“we”, “us”). These terms are the agreement between you and us for using it. By using the app you accept them; if you do not accept them, please do not use the app.

They are deliberately short. Nothing here is meant to catch you out, and where a term matters it is written in plain words rather than hidden in a clause.

What the app is

Velvet Hanger is a private record of the clothes you own and what you wore. It is not a shop, a social network, a backup service or a source of advice. We may make it available to you at no charge, or offer paid features; where a feature has a usage allowance, the allowance is part of what you are getting and may change.

Your account

You sign in with Apple, and your account is yours alone. You are responsible for the Apple ID you sign in with and for what happens under your account. Accounts are for individuals — please do not share one, and do not use somebody else's.

Your content, which stays yours

Everything you put into the app is yours: your photographs, your garment details, your wear history. Using Velvet Hanger does not transfer any ownership of them to us, and we make no claim on them.

You give us only the permission we need in order to run the service for you: to store your content, to process it (for example, to cut a garment out of its background), and to send it back to your own devices. That permission exists so the app can work, it is not exclusive, and it ends when you delete the content or your account.

If — and only if — you use the optional AI tagging feature, a garment photograph is also sent to our AI provider so that details can be suggested for it. We do not use your content to train models of our own. What our AI provider may do with what it receives is set out plainly on the Privacy page, including a trade-off you should read before turning tagging on.

You are responsible for having the right to upload what you upload, and you confirm that your content does not infringe anyone else's rights or break the law.

Use the app for its purpose — keeping a record of your own wardrobe — and not for these:

The service will change

We will add features, change them and remove them. We may pause the service for maintenance, and we may have to interrupt it for reasons outside our control. We may also stop offering the app altogether — if we do, we will give you reasonable notice and time to export your data before it goes.

We may change these terms too. When we do we will update this page and move the date at the top, and for a material change we will make a point of telling you rather than amending it quietly. Carrying on using the app after a change means you accept the updated terms.

No warranty

The app and the service are provided as-is and as-available, without warranties of any kind, whether express or implied. We do not promise that the app will be uninterrupted, error-free, available at any particular moment, or fit for a particular purpose of yours.

In particular: Velvet Hanger is not a backup service. It syncs your wardrobe so it can survive a lost phone, and we take reasonable care of it, but we cannot guarantee that content is never lost or corrupted. Keep your own copies of photographs that matter to you, and use Export my data if you want a file of your own.

Some jurisdictions do not allow certain warranties to be excluded. Where that is the case, this section applies only to the extent that the law permits, and your statutory rights as a consumer are unaffected.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits or business, or for lost or corrupted content or data arising out of your use of the app.

Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by our negligence, and for fraud.

Ending it

You may stop using Velvet Hanger at any time, and you can delete your account and everything in it from inside the app. Deletion is immediate and cannot be undone; what exactly it removes is set out on the Privacy page.

We may suspend or close an account that breaks these terms, or that we are legally required to close. Where it is reasonable and lawful to do so, we will tell you first and give you a chance to export your data.

The sections on your content, no warranty and liability continue to apply after your account ends.

The rest

These terms, together with the Privacy page, are the whole agreement between you and us about the app. If a part of them turns out to be unenforceable, the rest of them still stand. If we do not enforce a term straight away, we have not given it up. You may not transfer these terms to anyone else; we may transfer them if the business does, on the same terms.

The app is distributed through Apple's App Store, and Apple's own terms apply to that distribution alongside these. Apple is not a party to this agreement and is not responsible for the app.
